1. Definitions

Client: Refers to any individual or company who engages Golden Captures Media for media services.
Media Services: Refers to photography, videography, and any related digital products provided by Golden Captures Media.
2. Services
Golden Captures Media offers real estate photography, videography, drone footage, and other related media services. All services will be delivered as digital files, accessible through secure online delivery.
3. Bookings and Cancellations
Booking: Clients must book services through the company's official channels (website, email, or phone).
Cancellations: Cancellations must be made at least 2 hours before the scheduled appointment. Cancellations within 2 hours of the appointment may incur a cancellation fee.
4. Payment Terms
Pricing: All services are provided at the rates indicated on the company’s pricing guide or quoted directly to the client.
Deposit: A deposit may be required to secure a booking. The deposit is non-refundable if a cancellation is made less than 2 hours before the scheduled service.
Final Payment: The final payment must be completed before the delivery of the final media products. Payment methods include credit/debit card, bank transfer, or any other approved payment platform.
5. Delivery of Products
Delivery Timeframe: Standard delivery of digital products will be completed within 1 business day from the date of service.
Digital Access: The client will receive a link to download the media files, which will remain active for 90 days. It is the client’s responsibility to download and back up the files during this period.
6. Intellectual Property
Ownership: Golden Captures Media retains the copyright of all media products produced. Clients are granted a license to use the media for promotional purposes related to their real estate listings.
Usage Restrictions: Clients may not sell, distribute, or use the media for any purposes unrelated to their real estate listings without explicit written consent from Golden Captures Media.
7. Client Responsibilities
Property Access: The client must ensure that Golden Captures Media has access to the property at the scheduled time and that the property is in a presentable condition for media capture.
Permissions: The client is responsible for obtaining any necessary permissions for media capture, such as clearance from homeowners or tenants.
8. Revisions and Edits
Revisions: A limited number of revisions are included with each service package. Additional revisions may incur additional fees.
Scope of Edits: Revisions are limited to adjustments and corrections within the scope of the original service. Significant changes or requests outside the initial agreement may require additional charges.
9. Liability
Golden Captures Media will not be liable for any loss or damage, including direct, indirect, incidental, or consequential damages, arising from the use of our services or media products.
10. Force Majeure
Golden Captures Media is not liable for failure to perform services due to circumstances beyond our control, including but not limited to natural disasters, acts of government, or technical failures.
11. Governing Law
These terms and conditions are governed by the laws of the state of Texas, without regard to conflict of law principles.
12. Amendments
Golden Captures Media reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes through our website or via email.
13. SMS Privacy Policy
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
